Program Provider: The Plans He Has For Me, LLC (“TPHHFM”)
 

You are the defined “Participant” / “you”

Program Purpose: The Choose Alcohol-Free coaching program (“Program”) was designed to allow people an additional level of support over and above the daily devotional.  You will gain access to TPHHFM’s proprietary curriculum designed to reinforce principles outlined in the devotional.  

By accessing the Choose Alcohol-Free Program, you agree and commit to the following Terms Of Enrollment and Participation, so as to fully experience and gain maximum benefit from the Program: 

TERMS OF ENROLLMENT AND PARTICIPATION

Participation:
 

You agree to fully participate in all the following:
 

• Daily participation in The Plans He Has For Me Daily Devotional:   The Devotional was designed so that you engage in the following:
  1. Prayer (the Lord’s prayer):    This will allow you to practice Jesus’s instruction for an all-encompassing prayer for you each day and will allow you time to connect with your creator
  2. Gratitude:   Scientifically proven to allow you to start looking at the glass half full and not half empty.
  3. Reflections:   It is important to document your journey in written form so that you can understand truth and deception during the journey.  You will also be able to document how your life is improving over the 12-week period.
• Weekly Curriculum:   Curriculum will be available to you immediately  and will consist of 12 independent Core Concepts.  These Core Concepts are considered the cornerstone learnings that will give you the best chance of success of changing your relationship with alcohol of the 12-week period.  It is recommended that you focus on one Core Concept for each of the weeks of this challenge, but of course you are welcome to review any and all of them at any time.
• Private Facebook Group:  You are asked to give a reflection and be accountable to others in the Private Facebook Group for The Plans He Has For Me! at least once a week.   Reflections on the devotional, wins or struggles are all welcomed and encouraged.   Allowing what is in your mind to get out in the open will allow for what is set in the darkness to be exposed to the light.  This will also be a major factor in your success in the Program.  Access to the Private Facebook Group can be found at:  https://www.facebook.com/groups/1002609917019820.

You agree to fully read all the following:

• Program education and information is intended to assist your efforts of living an alcohol-free life for twelve consecutive weeks and making a shift with your relationship to alcohol to create the life you want and does not purport to be, nor should it be construed as professional addiction counseling services by medical professionals.

• All materials, procedures, policies, and standards, all manuals, all teaching aids, and the like that have been or will be made available by TPHHFM or its designated facilitators or coaches, or any other source, oral or written, are for individual use in or in conjunction with this Program only. 

• Program content is for individual use only, and may not be sold, tape recorded, videotaped, shared, taught, given away, or otherwise divulged without the express written consent of TPHHFM. 

• The information contained in the Program materials is strictly for educational purposes. Therefore, if you wish to apply (or not apply) ideas contained in this material, you are taking full responsibility for your actions. 

• TPHHFM assumes no responsibility for errors or omissions that may appear in any Program materials. 

Nature of this Relationship:

You acknowledge and agree that:

The Choose Alcohol-Free Program does not involve the diagnosis or treatment of substance abuse, or any other professional advice by legal, medical or other qualified professionals and that it is your exclusive responsibility to seek such independent professional guidance as needed.  TPHHFM is not a substance abuse counseling firm or health provider.  Rather, TPHHFM is a Program designed to assist you with your efforts at living an alcohol-free lifestyle. By participating in TPHHFM’s Program you are representing you have conferred with your health provider/s and you are not suffering from any condition that requires medical or psychological treatment.  You further represent your health provider has cleared you to participate in TPHHFM’s Program without any adverse health results.  If any time you need medical attention while participating in a TPHHFM Program, you should contact your health provider for assistance or call 911.   TPHHFM assumes no liability for any medical condition of any participant.  

TPHHFM’s role is to support and assist you in reaching your alcohol-free goals, but your ultimate success depends upon your personal effort, motivation, commitment, and follow-through. TPHHFM cannot predict and does not guarantee that you will attain a particular result, and you acknowledge and agree that results differ for everyone, depending upon his or her unique background, dedication, desire, motivation, actions and numerous other factors. You fully agree that there are no guarantees as to the specific outcome or results following your participation in the Choose Alcohol-Free Program.

Participation in TPHHFM’s Program is at your sole risk.  You agree to forever defend, indemnify and hold TPHHFM and its members, managers, employees, contractors, agents and representatives harmless from any injury, illness, medical conditions or complications, death, claims, demands, causes of action, suits, damages, losses, costs, lost profits, expenses, debts, dues, covenants, contracts, promises, warranties, representations, agreements, attorneys’ fees, costs and expenses whether past or existing, arising out of, or in any way related to, or connected with your participation in TPHHFM’s Program. 

Program Charge/s; Terms of Sale and Refund Policy:  

The Program cost is $150 to be paid via credit card below.

Once you access the Program materials, the fee is nonrefundable.

Ownership of Materials; Intellectual Property:

You acknowledge and agree that:

All the Choose Alcohol-Free materials and content, including without limitation that listed above, are proprietary to TPHHFM and TPHHFM shall continue to own all copyrights, trademarks and other proprietary rights in and to such materials and content (“TPHHFM’s Intellectual Property”). Nothing herein conveys or may be deemed to convey any of TPHHFM’s rights, title, or interest in and to TPHHFM’s Intellectual Property, except the limited non-exclusive license for you to personally utilize TPHHFM’s Intellectual Property for your own improvement. You shall not disclose TPHHFM’s Intellectual Property to any third party or in any way make commercial use thereof.

Governing Law; Jurisdiction and Venue; Attorney Fees. This Agreement shall be interpreted under the laws of the State of Arizona.  Any action to enforce or interpret any provision of this Agreement shall be commenced and completed in the Superior Court of the State of Arizona in and for the County of Yuma and not elsewhere.  Each party specifically submits themselves to the jurisdiction to said Court and waives any objection to venue.  If either party commences an action to enforce any term or condition of this Agreement, the prevailing party to such action shall be entitled to recover a reasonable additional sum as and for its attorneys’ fees and costs, said sum to be fixed by the Court.

Entire Agreement.  The foregoing constitutes the entire agreement between you and TPHHFM and may not be amended or otherwise modified except by the express written agreement of TPHHFM.
